Terms of Service

How the catalog, your account, and this site work.

By using sipcurator.com, you agree to these Terms of Service. If you do not agree, please do not use the Service.

Who we are

"We," "us," and "our" refer to Sip Curator, operating the website at sipcurator.com and the Sip Curator mobile app (together, the "Service"). "You" and "your" refer to anyone who visits or uses the Service.

Sip Curator is a spirits catalog. It helps people browse, compare, and learn about whiskey, tequila, rum, gin, vodka, brandy, liqueurs, and other bottles, along with cocktails made from them. The Service provides community scores, tasting notes, filters, label scanning, and related tools.

You must be of legal drinking age

The Service is intended only for people who are of legal drinking age. If you are in the United States, you must be at least 21 years old to use the Service. If you are outside the United States, you must be at least the legal drinking age where you live, and in no event younger than 18.

By using the Service, you represent and warrant that you meet this age requirement. Do not use the Service, create an account, or submit any information to us if you do not. We may refuse service, suspend, or delete any account if we have reason to believe the account holder is underage, and we may ask you to confirm your age at any time.

We do not sell alcohol

Sip Curator is an information service. We are not a retailer, importer, distributor, or licensed alcohol seller. We do not sell, ship, deliver, or arrange the delivery of alcoholic beverages, and we do not take orders for them. Any purchase you make happens entirely with a third-party retailer under that retailer's own terms, pricing, age verification, and return policies. We are not a party to that transaction and are not responsible for it.

Drink responsibly

Nothing on the Service encourages excessive, unlawful, or unsafe drinking. Alcohol carries health risks, and how it affects you depends on factors we know nothing about. The Service does not provide medical, health, legal, or other professional advice, and nothing on it should be treated as a substitute for advice from a qualified professional. Never drink and drive. If you are pregnant, taking medication, or have a health condition, talk to a doctor rather than relying on anything you read here.

Scores, tasting notes, and prices

Ratings and tasting notes on the Service are aggregated from public community reviews and other third-party sources. They are opinions, not statements of fact, and they represent the people who wrote them rather than us. Prices, sizes, proof, age statements, availability, and label images are provided for reference and may be out of date, regionally different, or wrong.

We make no representation or warranty that any Content on the Service is accurate, complete, reliable, current, or error-free, and we disclaim liability for any inaccuracy, error, or omission in it. Verify anything that matters to you — particularly price and alcohol content — with the retailer or producer before you rely on it. We do not guarantee that you will enjoy any bottle or cocktail the Service suggests.

Third-party sources and brands

The Service may display ratings, notes, images, and prices gathered from third-party sources. Sip Curator is not affiliated with, endorsed by, or sponsored by those sources, nor by any distillery, brand, or retailer named on the Service, unless we say so explicitly. Product names, brand names, logos, and bottle images belong to their respective owners and appear here for identification and commentary only. We do not guarantee the continued availability of any third-party data, and changes to those sources may affect the Service.

Your account

You can browse much of the Service without an account. If you create one, you agree that the information you give us is accurate and current, that you will keep your password confidential, and that you are responsible for everything that happens under your account. Do not impersonate anyone, use an email address that is not yours, or use the Service for any unlawful purpose. Tell us promptly if you believe your account has been compromised. You may delete your account at any time from the Sip Curator app or through our account deletion page.

Content you submit

You may be able to submit ratings, notes, shelf and collection entries, photos for label scanning, and support messages ("Your Content"). You keep whatever rights you already hold in Your Content. By submitting it, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, and display it in order to operate and improve the Service, including in aggregated or anonymized form.

You represent that you have the right to submit Your Content and that it does not infringe anyone else's rights or break any law. Do not submit anything false, misleading, defamatory, harassing, obscene, or unlawful, and do not submit photos or text you do not have the right to share. We may remove Your Content, or decline to display it, at our discretion.

Acceptable use

When using the Service, you agree not to:

  • Use the Service if you are under the legal drinking age that applies to you
  • Promote or facilitate underage drinking, drunk driving, or excessive consumption
  • Scrape, harvest, crawl, or bulk-download the catalog, or use bots or scripts to access the Service in an unauthorized manner
  • Redistribute, resell, or sublicense the catalog, scores, or other data from the Service without our prior written consent
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service
  • Submit fake or manipulated ratings, or otherwise try to distort scores
  • Harass, stalk, or intimidate anyone through the Service
  • Interfere with or disrupt the integrity, security, or performance of the Service
  • Use the Service to advertise or solicit without our permission

We may suspend or terminate your access, with or without notice, if you break these terms or if we reasonably believe your use of the Service creates risk or legal exposure for us or anyone else.

Paid features

The Service is free to browse. If we offer paid features, the price and billing period will be shown before you buy, and by subscribing you authorize us to charge your payment method for the applicable fees on a recurring basis until you cancel. You can cancel at any time in your account settings or through our support page; access continues until the end of the billing period you have already paid for. We do not provide prorated refunds for partial periods except where required by law. If we change subscription fees, we will give you notice before the change takes effect.

Purchases made through the Apple App Store or Google Play are also subject to that store's terms, and refunds for those purchases are handled by the store rather than by us.

Our intellectual property

The Service, including its design, text, software, and the selection and arrangement of the catalog, is owned by Sip Curator or its licensors and is protected by copyright, trademark, and other laws. You may use it for your own personal, non-commercial purposes. You may not copy, modify, publish, transmit, sell, create derivative works from, or otherwise exploit any part of the Service without our prior written consent. Nothing in these terms grants you any license to our trademarks or to those of any third party.

Links to other sites

The Service may link to third-party websites, including retailers. We do not control those sites and are not responsible for their availability, accuracy, content, pricing, age verification, or privacy practices. A link is not an endorsement. You use those sites at your own risk and under their terms.

Changes to the Service and to these terms

We may change, suspend, or discontinue any part of the Service at any time. We may also amend these Terms of Service; the amended version takes effect when we post it on this page, and we will update the effective date below. Your continued use of the Service after that means you accept the change. Please review this page periodically.

Disclaimer of warranties

THE SERVICE AND ALL CONTENT, SCORES, NOTES, AND DATA PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SIP CURATOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SIP CURATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE, INCLUDING WITHOUT LIMITATION ANY DAMAGES RELATED TO (I) YOUR CONSUMPTION OF ALCOHOL OR ANY DECISION YOU MAKE BASED ON CONTENT ON THE SERVICE; (II) ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY, COMPUTER VIRUS, OR SYSTEM FAILURE; (III) LOSS OF REVENUE, PROFITS, BUSINESS, GOODWILL, OR DATA; OR (IV) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR INFORMATION, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR CUMULATIVE LIABILITY TO YOU EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THESE EXCLUSIONS OR LIMITATIONS, IN WHICH CASE THEY APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

Indemnification

You agree to indemnify and hold us harmless from any losses, damages, liabilities, costs, and expenses, including reasonable attorney's fees, arising out of your breach of these Terms of Service, Your Content, or your use of the Service. You will provide reasonable assistance, at no charge, in the defense of any such claim, and you will not settle any claim or waive any defense without our prior written consent.

Governing law

These Terms of Service, and any dispute arising between you and Sip Curator or its affiliates, are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles. You agree that the state and federal courts located in Washington have exclusive jurisdiction over any such dispute, and you consent to venue there.

Severability, entire agreement, and waiver

If any provision of these terms is held invalid or unenforceable, the rest remains in full force. These Terms of Service, together with the Privacy Policy, are the entire agreement between you and Sip Curator regarding the Service and supersede any prior agreements or understandings. Our failure to enforce any provision is not a waiver of it, and no waiver is binding unless we put it in writing. Section headings are for convenience only and do not affect interpretation. If either of us brings a legal action to enforce these terms, the prevailing party is entitled to recover reasonable attorney's fees and costs.
